A few owners feel they are above the law and can avoid paying their service charge.
Guardian take the issue of non-payment of service charge very seriously. To this their legal team recently issued a Statutory Demand under section 268(1)(a) of the Insolvency Act 1986 for the outstanding sum of £2,245.82.
The next step if this amount is not paid in full will be application to the courts for forfeiture of the lease. If successful this will result in re-entry by bailiffs acting on behalf of the management company and subsequent sale of the property and recovery of the outstanding service charge and significant costs.
